مصير عقود الإيجار القديم بعد حكم «الدستورية»

قانون الإيجار القديم.. لا ينطبق حكم المحكمة الدستورية العليا بشأن تعديل قانون الإيجار القديم على العقود، التي خضعت لـ القانون رقم 4 لسنة 1996، وذلك وفقاً لما صرح به خبراء القانون الدستوري.
مصير عقود الإيجار القديموأوضح يسري مهران، المحامي في النقض والدستورية العليا أن تحرير عقد إيجار قديم في ظل القانون رقم 4 لسنة 1996، قد تصل مدة الإيجار فيها لـ 59 سنه، يشبه الإيجار القديم، ولكن مع اختلاف القيمة الإيجارية، حيث تم دفع مقدم يصل إلى 100 أو 200 ألف جنيه مع إيجار شهري 500 أو 800 جنيه.
وقال المحامي في النقض والدستورية العليا في تصريحات صحفية سابقة: إن في هذه الحالة لا ينطبق حكم المحكمة الدستورية على الإيجار القديم، ويظل العقد ساري بنفس الشروط دون المساس بالقيمة الإيجارية أو امتداد عقد الإيجار.
وأضاف يسري مهران أن عقد الإيجار المبرم في ظل القانون رقم 1996، يطبق عليه أحكام القانون المدني، وهي العقد شريعة المتعاقدين، ولا ينتهي بوفاة المؤجر بل يمتد للورثة سواء الأبناء أو أبناء العمومة، أو أي وريث شرعي للمتوفى.
الجدير بالذكر أن المحكمة الدستورية العليا، برئاسة المستشار بولس فهمي، قضت يوم 9 نوفمبر 2024، بعدم دستورية الفقرة الأولى من المادتين (1 و2) من القانون رقم 136 لسنة 1981 في شأن بعض الأحكام الخاصة بتأجير الأماكن، وتنظيم العلاقة بين المؤجر والمستأجر، فيما تضمنتاه من ثبات الأجرة السنوية للأماكن المرخص في إقامتها لأغراض السكنى اعتبارًا من تاريخ العمل بأحكام هذا القانون.
وقالت المحكمة الدستورية، في حيثيات حكمها، إن ثبات القيمة الإيجارية عند لحظة من الزمان ثباتًا لا يزايله مضي عقود على التاريخ، الذي تحددت فيه «يشكل عدوانًا على قيمة العدل وإهدارًا لحق الملكية».
وأصدر مجلس النواب بيان بشأن حكم المحكمة الدستورية العليا لـ قانون الإيجار القديم قائلاً إن المجلس، كلف لجنة الإسكان بإعداد دراسة مستفيضة عن ملف قوانين «الإيجار القديم»، لـ تقييم أثرها التشريعي، وفق محددات معينة أهمها الخلفية التاريخية لهذه التشريعات، وأحكام المحكمة الدستورية المتعلقة بها.
وقال مجلس النواب إن لجنة الإسكان، أعدت تقرير مبدئي عن موضوع الإيجار القديم، ومن المقرر عرضه خلال الجلسات العامة القادمة.
وأكد مجلس النواب أنه سيواصل مناقشة القوانين الاستثنائية لإيجار الأماكن، والتعديلات التشريعية اللازمة لتنفيذ حكم المحكمة الدستورية بروح من التوازن والعدالة، ملتزمًا بحماية مصالح جميع الأطراف دون تغليب مصلحة طرف على حساب طرف آخر.
