نائب رئيس المحكمة الدستورية العليا يؤكد أهمية الاستفادة من التجارب الدولية.. فيديو

بدأت أعمال الاجتماع الثامن لرؤساء المحاكم الدستورية والعليا والمجالس الدستورية الأفريقية، في يومه الثاني بالجلسة الثالثة من جلساته، وعنوانها “الرقابة الدستورية على التشريعات المنظمة للظروف الاستثنائية”.
ترأس الجلسة القاضي لوك مالابا، رئيس المحكمة الدستورية بزيمبابوي)، ودارت مناقشات واسعة بين رؤساء المحاكم الدستورية والعليا والمجالس الدستورية الأفريقية المشاركة في الاجتماع، وصولاً لوضع التوصيات النهائية لهذا الاجتماع، والتي تمثلت في 13:
أولاً: التسليم بأهمية توافر تشريعات وسياسات وتدابير تكفل تحقيق المواجهة المناسبة والفعالة للظروف الاستثنائية.
ثانيًا: التأكيد على أهمية الدور الدستوري الذي تضطلع به سلطات بلادنا في التعامل مع الظروف الاستثنائية والطارئة.
ثالثًا: أن التحدي الذي يُمثله التعامل مع الظروف الاستثنائية والطارئة، وتحقيق أهداف هذه المواجهة قائم على تقديرات وملائمات واقعية تنعكس على طبيعة التدابير والسياسات التي تتخذها دولنا حيالها.
رابعًا: الإقرار بأهمية الاستفادة من التجارب الدولية في تحقيق المواجهة التشريعية والتنفيذية للظروف الاستثنائية والطارئة.
خامسًا: أن التطور العلمي والتكنولوجي قد صاحبه تأثير ملحوظ في طبيعة ونطاق وآثار الظروف الاستثنائية والطارئة، وهو ما أسهم في امتداد مُسبباتها وآثرها لأكثر من دولة.
سادسًا: إن مواجهة الظروف الاستثنائية الطارئة لا تحتم دومًا اللجوء إلى السلطات الاستثنائية، بل السياسات والتدابير العادية قد تكون كافية في التعامل مع هذه الظروف، وصون المقومات الأساسية لمجتمعاتنا، وحماية حقوق المواطنين وحرياتهم.
سابعًا: التأكيد على التمسك بسيادة القانون والإدارة الرشيدة وتحقيق التناسب بين مواجهة الظروف الاستثنائية ومقتضيات تحقيق المصلحة العامة وحماية حقوق الإنسان وحرياته الأساسية، وهو شرط مسبق ورئيسي لخلق وتهيئة بيئة تتيح تحقيق التنمية وحماية الأمن القومي والنظام العام والسلامة والصحة العامة.
ثامنًا: التأكيد على أن المواجهة الفعالة والمنصفة للظروف الاستثنائية والطارئة، قرين بأن يكون في أضيق الحدود، وأن يراعي شرط التناسب، وأن يكون مؤقتًا، وأن من الحقوق والحريات ما لا يجوز المساس به أو تقييده بأية صورة.
تاسعًا: التشديد على أهمية دور الجهات القضائية – في حـــــدود ولايتها الدستورية – في مراقبة التشريعات واللوائح والتدابير التي تتخذها دولنا في إطار مواجهة الظروف الاستثنائية والطارئة، والتحقق من مراعاتها الشروط والمعايير الدستورية.
عاشرًا: التأكيد على أهمية دور الجهات القضائية في حماية حقوق الإنسان وحرياته، من خلال توفير الترضية القضائية لكافة الأفراد.
حادي عشر: التأكيد - كذلك - على أهمية استفادة الجهات القضائية الأفريقية من التحول الرقمي والتطورات العلمية والتكنولوجية المختلفة في توفير خدمات التقاضي للكافة وبصورة آمنة، ضمانًا لحقهم في العدالة الناجزة.
ثاني عشر: التسليم بأهمية التوافق على معايير ومبادئ مشتركة لمواجهة المسائل القانونية المستحدثة التي أنبتها التطور العلمي في مجتمعاتنا المعاصرة، مع مراعاة الاختلافات الثقافية والاجتماعية والأخلاقية لكل دولة.
ثالث عشر: الترحيب بما تم من إنشاء مركز البحوث والدراسات الدستورية الأفريقية. ونوصي الهيئات القضائية الأفريقية بالتعاون مع المركز، والاستعانة بالدراسات والأبحاث القانونية التي يجريها المركز أو يُشرف عليها، والاستفادة من الأنشطة العلمية الأخرى التي يضطلع بها، خاصة برامج تدريب وإعداد القضاة.
