إسرائيل نحو أزمة دستورية بعد رفض الاعتراف برئيس المحكمة العليا

قالت وسائل إعلام إسرائيلية إن إسرائيل تتجه إلى أزمة دستورية، حيث أعلن وزير العدل ياريف ليفين أنه لا يعترف بالقاضي يتسحاق عميت رئيسا للمحكمة العليا، بعدما عينته لجنة تعيين القضاة في هذا المنصب رسميا اليوم الأحد.
ووصفت القناة الـ12 ما جرى بأنه سابقة في إسرائيل، و"صدام فعلي بين السلطتين القضائية والتنفيذية".
ورأى وزير العدل أن هذا التعيين غير قانوني، وأرسل إلى إدارة المحاكم بأنه لا يعترف بعميت رئيسا للمحكمة العليا والسلطة القضائية، وفقا لما أورده الإعلام الإسرائيلي.
وكانت المحكمة العليا قد قضت بإلزام وزير العدل بعقد جلسة رسمية لتعيين رئيس للمحكمة العليا بعد شغور المنصب لمدة سنة و4 أشهر، عقب انتهاء ولاية القاضية استير حيوت.
وعارض الوزير هذا القرار وطالب بتأجيل الجلسة عدة مرات، لكن لجنة تعيين القضاة انعقدت اليوم الأحد، وصوتت لأول مرة في تاريخ إسرائيل على تعيين رئيس للمحكمة العليا من دون مشاركة رئيس اللجنة وهو وزير العدل بحكم القانون.
جدل واتهامات
وأثارت هذه التطورات جدلا واسعا في إسرائيل تزامنا مع خلافات أخرى بشأن ارتدادات اتفاق وقف إطلاق النار في غزة، ومطالب بمحاسبة المسؤولين عن الإخفاق وراء هجوم 7 أكتوبر/تشرين الأول 2023.
إعلانوانتقد وزراء في الائتلاف الحكومي اليميني تعيين رئيس المحكمة العليا، فيما رحّبت به المعارضة.
وقال وزير المالية بتسلئيل سموتريتش إن القاضي يتسحاق عميت "تم تعيينه بشكل غير قانوني"، ووصف ما جرى بأنه "إجراء غير سليم ودكتاتوري يستنزف ما تبقى من ثقة الجمهور في مؤسسة المحكمة العليا"، داعيا عميت إلى الانسحاب.
في السياق نفسه، قال وزير الاتصالات شلومو كارعي "لقد فهم الجميع ما ستكون عليه نتائج المجمع الفاسد. لن يتحمل الشعب قمعه. سنقوم بتفكيك وإعادة بناء المحكمة العليا ومكتب المستشارة القانونية من الألف إلى الياء".
في المقابل، قال زعيم المعارضة يائير لبيد إن اختيار عميت رئيسا للمحكمة العليا هو "انتصار للديمقراطية والإدارة السليمة".
وأضاف أن المماطلة تسببت في أضرار جسيمة لحكم القانون في إسرائيل، وفق تعبيره.
