التعليم: الحكم القضائي والإخلال بالمسئوليات تُنهي تكليف المشرفين التربويين

أكدت وزارة التعليم أنه يتم إنهاء تكليف المشرفين التربويين في حال الإخلال بالمسؤوليات والواجبات الوظيفية، أو صدور حكم قضائي يتعارض مع المصلحة التربوية والتعليمية، وعدم تحقيق مؤشرات الأداء المقررة وفق التقييمات المعتمدة وغيرها من الجوانب الخاصة بإنهاء تكليفات المشرفين.

ضوابط إنهاء التكليف
وفقًا للوثيقة، يتم إنهاء تكليف شاغلي الوظائف التعليمية بالتشكيلات الإشرافية بناءً على عدة ضوابط، تبدأ أولها بانتهاء مدة التكليف المحددة في القرار الصادر، دون أن يتم تمديد هذه المدة.
وهذا يعني أنه عندما تنتهي فترة التكليف المحددة، فإن التكليف ينتهي تلقائيًا دون الحاجة إلى إصدار قرار جديد، وذلك في حالة عدم صدور تمديد له.
انخفاض الأداء الوظيفي
وتضمنت الوثيقة ضوابط صارمة تتعلق بالأداء الوظيفي للمكلفين، حيث ينص على إنهاء تكليف المشرف التربوي في حالة انخفاض أدائه الوظيفي. ويتم قياس هذا الأداء بناءً على التقييم المنصوص عليه في بطاقة الوصف الوظيفي المعتمدة للمشرف. فإذا حصل المكلف على تقدير أقل من "جيد جداً" في تقييم الأداء الوظيفي خلال آخر عامين متتاليين، يتم إنهاء تكليفه على الفور.
طلب الجهة المالكة للمقعد
كما تضمنت الضوابط منح الجهة المالكة للمقعد الإشرافي صلاحية تقديم طلب لإنهاء تكليف المشرف، بشرط أن يكون هذا الطلب مدعومًا بالمبررات والشواهد، وأن يكون مستندًا إلى تقييم الأداء ومؤشراته المعتمدة للمهمات المناطة بالمشرف. ويجب إشعار المكلف بقرار إنهاء تكليفه قبل تاريخ التنفيذ بما لا يقل عن 15 يومًا. وبعد تقديم الطلب، يتم مخاطبة الجهة المسؤولة لاعتماد القرار من قبل صاحب الصلاحية، وفقًا لما نصت عليه المادة رقم (71) من اللائحة التنفيذية للموارد البشرية.
المصلحة العامة والتعليمية
تضمنت الوثيقة أيضًا بندًا يسمح بإنهاء تكليف المشرف التربوي إذا اقتضت المصلحة العامة أو التعليمية ذلك. ويشترط في هذه الحالة أن تكون الأسباب واضحة ومشفوعة بالمبررات، ويتم رفعها لأخذ الموافقة من صاحب الصلاحية المختص الذي يملك الحق في إيقاف التكليف.
الإخلال بالمسؤوليات والواجبات
وفيما يتعلق بالالتزام بالمسؤوليات الوظيفية، تنص الوثيقة على إنهاء تكليف المشرف التربوي في حال الإخلال بالمسؤوليات والواجبات الوظيفية المحددة في مدونة قواعد السلوك الوظيفي وأخلاقيات الوظيفة العامة. ويُعد هذا الإجراء ضروريًا لضمان أن يكون جميع المشرفين على مستوى عالٍ من الالتزام والمسؤولية تجاه وظائفهم.
الحكم القضائي
وتشمل الضوابط أيضًا إنهاء تكليف المشرف التربوي في حالة صدور حكم قضائي في قضية تتعارض مع المصلحة التربوية والتعليمية. ويُعد هذا الإجراء جزءًا من جهود الوزارة للحفاظ على نزاهة العملية التربوية وضمان أن يكون جميع العاملين في المجال التعليمي على مستوى من النزاهة والأخلاق المهنية.
النقل الخارجي
كما تضمنت الوثيقة بندًا يتعلق بإنهاء تكليف المشرف التربوي في حال نقله ضمن إدارات النقل الخارجي، إلا في الحالات التي تنص التعليمات فيها على استثنائه. وهذا الإجراء يهدف إلى ضمان استمرارية العمل التربوي والإشرافي ضمن الإدارات التعليمية المختلفة.
عدم نظامية التكليف
وفي حالة ثبوت عدم نظامية التكليف أو حدوث خطأ في إجراءات التكليف، يتم إنهاء التكليف فورًا.
ويُعد هذا الإجراء ضروريًا لضمان الالتزام بالضوابط والشروط النظامية والإجراءات المعتمدة في عملية التكليف.
عدم تحقيق مؤشرات الأداء
وأخيرًا، تنص الوثيقة على إنهاء تكليف المشرف التربوي في حال ثبوت عدم مساهمته في تحقيق مؤشرات الأداء المقررة ضمن مهامه الإشرافية. ويشمل ذلك عدم تحقيق الأهداف المتعلقة بتطوير الأداء المدرسي المقررة من قبل وكالات التعليم المختلفة مثل وكالة التعليم العام ووكالة الطفولة المبكرة ووكالة تنمية القدرات. وهذا البند يشدد على أهمية دور المشرف في تحسين الأداء المدرسي وضمان تحقيق الأهداف التعليمية التي تسعى الوزارة إلى تحقيقها.
