غدًا.. الحكم فى دعوى بطلان الجمعية العمومية لنادي الأهلي

تصدر محكمة القضاء الإداري بمجلس الدولة، غدًا الأحد، الحكم في الدعوى المقامة من خالد سليمان أبوالعلا، ويطالب فيها ببطلان انعقاد الجمعية العمومية الأخيرة لنادي الأهلي.
وكان خالد سليمان أبوالعلا، أقام دعوى قضائية أمام محكمة القضاء الإداري بمجلس الدولة حملت رقم 17905 لسنة 77 ق، ضد رئيس مجلس إدارة نادي الأهلي بصفته، لوقف تنفيذ قرار اعتماد قرارات انعقاد الجمعية العمومية لنادي الأهلي والتي انعقدت في 29 نوفمبر الماضي.
واختصمت الدعوى كلًا من رئيس مجلس إدارة نادي الأهلي بصفته، وزير الدولة لشئون الرياضة، وكيل مديرية الشباب والرياضة بالقاهرة، رئيس اللجنة الأوليمبية المصرية.
وطلب المدعي إلغاء قرار اعتماد صحة انعقاد الجمعية العمومية لنادي الأهلي المنعقدة في نوفمبر الماضي يوم 29، لبطلان كافة الإجراءات التي تم عقدها بها، وبالتالي بطلان كافة القرارات التي تم اتخاذها وقت انعقاد هذه العمومية وما يترتب على ذلك من آثار، وأن ينفذ الحكم بمسودته ودون إعلان، وإلزام المطعون ضدهم بالمصروفات القضائية.
سياقٍ مُتصل، أصدرت محكمة جنايات القاهرة، المُنعقدة بمُجمع محاكم القاهرة الجديدة في التجمع الخامس، بمُعاقبة المُتهم خالد.م بالحبس مع الشغل لمدة 6 أشهر، وذلك لإدانته بتعاطي المُخدرات في التجمع الأول.
وشمل الحكم تغريمه مبلغ 10 آلاف جنيه عما أسند إليه، ومصادرة المخدر المضبوط، وألزمته بالمصاريف الجنائية، وأمرت بإيقاف تنفيذ عقوبة الحبس فقط لمدة 3 سنوات.
صدر الحكم برئاسة المستشار ياسر أحمد الأحمداوي رئيس المحكمة، وعضوية السيدين المُستشارين د.عادل محمد السيوي، وعمرو علي كساب الرئيسين بمحكمة استئناف القاهرة.
وبحضور الأستاذ محمد صالح وكيل النيابة، والأستاذ محمد طه أمين السر.
وقالت المحكمة في حيثيات الحُكم إنه نظراً لظروف الدعوى ومُلابساتها فالمحكمة ترى أخذ المُتهم بقسطٍ من الرأفة في نطاق ما خولته لا المادة 17 من قانون العقوبات.
وحيث إنه وإعمالاً للسياسة القضائية التي انتهجها المُشرع والتي تستهدف من العقاب ما يتحقق به الردع، وكانت المحكمة ترى أن ما عاناه المُتهم من إجراءات تحقيق ومحاكمة من شأنه ردعه وعدم عودته مُستقبلاً إلى إتيان مثل تلك الأفعال.
ومن ثم فإنها بموجب السلطة التي خولها لها القانون بنص المادتين 55 و56 من قانون العقوبات تأمر بوقف تنفيذ عقوبة الحبس فقط المقضي بها عليه وذلك لمدة 3 سنوات.
وحيث أنه عن المصروفات الجنائية فالمحكمة تلزم بها المحكوم عليه عملاً بنص المادة 313 من قانون الإجراءات الجنائية.
