إدانة 3 مستثمرين لمخالفتهم نظام السوق المالية وتغريمهم 5.5 مليون ريال

أدانت لجنة الاستئناف في منازعات الأوراق المالية 3 مستثمرين “أب وابنه وابنته” لمخالفتهم نظام السوق المالية ولوائحه التنفيذية وإلزامهم بدفع 5.5 مليون ريال.
وجاء ذلك لقيامهم بإدخال أوامر شراء بهدف التأثير على سعر السهم/الوحدة (ارتبط بعضها بأوامر بيع)، وإدخال أوامر شراء بهدف التأثير على سعر مزاد الإغلاق (ارتبط بعضها بأوامر بيع).
وأشارت الهيئة إلى أن علي بن سالم بن أحمد بكلكا وابنه سالم بن علي بن سالم بكلكا، إضافة إلى ابنته سلطانة بنت علي بن سالم بكلكا، قاموا بذلك أثناء تداولهم من خلال محافظهم الاستثمارية على أسهم الشركات المدرجة ووحدات الصناديق العقارية المتداولة (شركة الصناعات الكهربائية، صندوق الجزيرة ريت، صندوق المعذر ريت، صندوق سيكو السعودية ريت، شركة سلامة للتأمين التعاوني، الشركة العربية السعودية للتأمين التعاوني “سايكو”، شركة تشب العربية للتأمين التعاوني وشركة الصقر للتأمين التعاوني) وذلك خلال الفترة من تاريخ 02/12/2020م وحتى تاريخ 08/08/2021م.
وشكلت الهيئة هذه التصرفات والممارسات تلاعباً واحتيالاً، وأوجدت انطباعاً مضللاً وغير صحيح في شأن الورقة المالية للشركات ووحدات الصناديق المشار إليها.

وأوضحت الشركة أن صافي متحصلات الطرح سيتم توزيعه للمستثمرين البائعين، في إطار خطتها الاستراتيجية لتوسيع قاعدة المساهمين وتعزيز حضورها المؤسسي في السوق العقاري السعودي.
