حدد قانون تنظيم أماكن وساحات انتظار السيارات، المعروف إعلاميًا بقانون "السايس"، الحالة التي يتم فيها إلغاء رخصة السايس.
رسوم رخصة السايسنص قانون تنظيم أماكن وساحات انتظار السيارات المعروف إعلاميًا بقانون "السايس" على أن تقدم طلبات استخراج الرخصة إلى اللجنة التي تتولى فحصها ومنحها، وفقًا للإجراءات التي تحددها اللائحة التنفيذية لهذا القانون.
وتكون الرخصة لمدة 3 سنوات قابلة للتجديد، ويجب على المرخص له، تقديم طلب التجديد خلال الشهر الأخير من مدة الترخيص.
ويصدر قرار من المحافظ أو رئيس جهاز المدينة، بحسب الأحوال، بتحديد رسم استخراج الرخصة، بما لا يجاوز 2000 جنيه.
شروط مزاولة مهنة السايسوضع قانون تنظيم أماكن وساحات انتظار السيارات المعروف إعلاميًا بقانون "السايس"، شروطا لمزاولة مهنة السايس، حيث يشترط فيمن يزاول نشاط تنظيم انتظار المركبات، الآتي:
- ألا يقل سنه عن 21 سنة يوم تقدمه بطلب الترخيص للجهة المختصة بإصداره.
- إجادة القراءة والكتابة.
- أن يكون قد أدى الخدمة العسكرية أو أعفى من أدائها قانونًا.
- أن يكون حاصلًا على رخصة قيادة سارية.
- ألا يكون حكم عليه بعقوبة جناية أو في جريمة مخلة بالشرف أو الأمانة أو المخدرات أو التعدي على النفس، ما لم يكن قد رد إليه اعتباره.
- الحصول على شهادة صحية من الطب الشرعي أو المعامل المركزية بوزارة الصحة تفيد خلوه من تعاطي المواد المخدرة.
كما يجوز للجنة المختصة في حالة تحصيل المرخص له مبالغ مالية من قائدي المركبات تجاوز القيمة المحددة بمعرفة اللجنة، إلغاء الرخصة بقرار مسبب.
المستندات المطلوبة للحصول على رخصة السايسجاءت في اللائحة التنفيذية لقانون تنظيم انتظار المركبات في الشوارع في مادتها الأولى، أنه يقدم طلب استخراج رخصة مزاولة نشاط تنظيم انتظار المركبات للجنة المختصة المنصوص عليها في المادة 3 من القانون، مرفقا به المستندات الآتية:
- صورة بطاقة الرقم القومي أو جواز سفر سارٍ.
- المؤهل الدراسي لطالب الترخيص أو مستخرج رسمي منه ما لم يكن ذلك مثبتا في البطاقة، أو شهادة محو أمية.
- تقديم ما يفيد بأداء الخدمة العسكرية أو الإعفاء من أدائها قانونا.
- صورة من رخصة قيادة سارية يجب تقديم أصل المستند.
- صحيفة الحالة الجنائية.
شهادة صحية تفيد بعدم تعاطي المواد المخدرة.
عقوبات قانون السايسيعاقب قانون تنظيم أماكن وساحات انتظار السيارات المعروف إعلاميًا بقانون "السايس " بالحبس مدة لا تجاوز ستة أشهر وبغرامة لا تقل عن خمسة ألاف جنيه ولا تزيد على عشره ألاف جنيه أو بإحدى هاتين العقوبتين كل من مارس نشاط تنظيم انتظار المركبات في غير الأماكن المحددة أو بدون ترخيص، وتضاعف العقوبة بحديها في حالة العود.
كما يعاقب بالحبس مدة لا تجاوز ثلاثة أشهر وبغرامة لا تقل عن ألف جنيه ولا تزيد على خمسة آلاف جنيه أو بإحدى هاتين العقوبتين كل مرخص له بمزاولة نشاط انتظار المركبات حصل مبالغ مالية من قائدي المركبات تجاوز القيمة المحددة بمعرفة اللجنة، وتضاعف العقوبة بحديها في حالة العود.
